This Disclaimer applies to your use of DirtLink (the "Service"), operated by Earth Movers Network Inc., operating as 'DirtLink' ("we," "us," "our"). It supplements our Terms and Conditions; in the event of conflict, the Terms and Conditions prevail.

1. No professional advice

DirtLink provides information about development permits, earth material, and connections between users. Nothing on the Service constitutes legal, engineering, environmental, or financial advice. Always consult qualified professionals before making decisions about earth material handling, soil contamination, structural fill, environmental compliance, or related matters.

2. Permit and site data accuracy

Permit information shown on the Service is sourced from the City of Calgary Open Data Portal. We do not independently verify, validate, or update this data beyond what the City publishes. Permit details may be incomplete, outdated, or inaccurate.

Always verify permit information directly with the City of Calgary before relying on it for business decisions. We are not responsible for losses caused by inaccurate permit data.

Permit data is used under the Open Government Licence – City of Calgary. See our Open Data Attribution Notice for details.

3. Marketplace role

We are a platform that connects users. We are not a party to any agreement, transaction, or exchange between users of the Service. Specifically, we do not:

  • Verify the identity, qualifications, or licensure of users.
  • Inspect or test material listed on the Service.
  • Verify quantity, type, contamination status, or quality of any material.
  • Mediate disputes between users.
  • Guarantee that material exchanges, payments, or pickups will occur as agreed.

4. Material quality, contamination, and environmental compliance

Earth material exchanged through DirtLink may contain contaminants, debris, or other hazards not disclosed in any listing. Soil and fill from a development site may be subject to environmental regulations under the Alberta Environmental Protection and Enhancement Act and Alberta Tier 1/Tier 2 Soil and Groundwater Remediation Guidelines.

You are solely responsible for:

  • Inspecting any material before accepting it.
  • Performing any environmental testing required by your project or by law.
  • Verifying that material meets the requirements for your intended use.
  • Complying with all applicable environmental, transportation, and disposal regulations.

We make no representations or warranties about the quality, safety, or suitability of any material listed on the Service.

5. Independent contractors and agency

Users of DirtLink are independent contractors and customers. They are not agents, employees, or representatives of Earth Movers Network Inc. We do not endorse, sponsor, or guarantee any user.

6. Third-party links and content

The Service may include links to third-party websites or content. We do not control these and are not responsible for their content, privacy practices, or terms.

7. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS.

8. Limitation of liability

Our liability is limited as set out in Section 10 of our Terms and Conditions. In no event will we be liable for any direct, indirect, incidental, special, or consequential damages arising from your reliance on information on the Service, your interactions with other users, or any material exchange that occurs as a result of using the Service.

9. Local laws and your responsibility

You are solely responsible for ensuring your use of the Service and any material exchange complies with all applicable laws, by-laws, and regulations, including land use bylaws, the City of Calgary Land Use Bylaw, environmental regulations, and transportation rules. We do not provide legal compliance advice.
