Copyright Notice and Takedown Procedure

Earth Movers Network Inc., operating as 'DirtLink' ("we," "us," "our") respects intellectual property rights. This document explains how to notify us of suspected copyright infringement on DirtLink and how we respond. This procedure is consistent with the Notice-and-Notice regime under sections 41.25 to 41.27 of the Canadian Copyright Act.

1. Submitting a notice of claimed infringement

If you believe content on the Service infringes your copyright, send a written notice to legal@dirtlink.ca (or by mail to 914 19th Ave SE, Calgary, AB) including all of the following:

  • Your full name, mailing address, telephone number, and email address.
  • A clear description of the copyrighted work you claim is being infringed.
  • The location (URL or specific page on dirtlink.ca) of the alleged infringing content.
  • The date and time of the alleged infringement, if applicable.
  • A statement, made in good faith, that the use of the work is not authorized by you, your agent, or the law.
  • A statement that the information in the notice is accurate.
  • Your physical or electronic signature.

2. What we do upon receipt

Upon receiving a complete notice that meets the requirements above:

  • Within ten business days we forward the notice electronically to the user who posted the content, as required by section 41.26(1) of the Copyright Act.
  • We retain records of the notice for six months from the date of forwarding (or one year if related to court proceedings).
  • We do not automatically remove the content; the Notice-and-Notice regime requires forwarding, not removal.
  • We may, at our discretion under our Terms and Conditions and Acceptable Use Policy, remove content that is clearly infringing pending dispute resolution.

3. Counter-notice

If you are the user who posted content that has been the subject of a notice, you may submit a counter-notice to legal@dirtlink.ca including:

  • Your full name, mailing address, telephone number, and email address.
  • Identification of the content and its location.
  • A statement, made under penalty of perjury, that you have a good-faith belief the content does not infringe or that you have authorization to use it.
  • Your consent to the jurisdiction of the courts of Alberta.
  • Your physical or electronic signature.

We will forward the counter-notice to the original notifier and may, in our discretion, restore content that was removed.

4. Repeat infringers

Accounts that are subject to repeated, credible copyright notices may be suspended or terminated under our Acceptable Use Policy. We may also take action against a single, willful, large-scale infringement.

5. Misuse of the takedown process

Submitting a knowingly false notice may result in liability under section 41.26 of the Copyright Act and other applicable law. Do not use this procedure to address content that is not actually infringing (for example, content you simply dislike).
