Privacy Policy
Earth Movers Network Inc., operating as 'DirtLink' (CRA Business Number 8267292) ("we," "us," "our") operates DirtLink at dirtlink.ca (the "Service"). This Privacy Policy explains what personal information we collect, how we use it, and the choices you have. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Alberta's Personal Information Protection Act (PIPA).
1. Information we collect
We collect information in three ways:
Information you provide
- Account information: name, email address, phone number (optional), company name, business role.
- Listing content: site addresses, material details, photos, soil reports, project timelines.
- Payment information: handled by Stripe Payments Canada, Ltd. — we receive billing details and the last four digits of your card; we do not store full payment card numbers.
- Communications: messages you send through the Service, replies to our emails, and support requests.
Information we collect automatically
- Usage data: pages visited, features used, time spent, referral source.
- Device data: IP address, browser type, operating system, device identifiers.
- Cookies and similar technologies (see Section 5 and our Cookie Notice).
Information from third parties
- Public records: development permit data from the City of Calgary Open Data Portal. This data is publicly available and is not linked to private accounts unless you claim a permit on the Service.
2. How we use your information
- Operate the Service — display your listings, match you with relevant sites, process payments.
- Communicate with you — service announcements, support responses, billing notices, and marketing emails (you can opt out at any time).
- Improve the Service — analyze usage patterns, develop new features, debug problems.
- Comply with legal obligations and enforce our Terms.
- Prevent fraud, abuse, and security incidents.
3. Legal basis under PIPEDA and PIPA
We collect, use, and disclose personal information based on:
- Express consent — when you create an account, opt into marketing communications, or share specific listing information.
- Implied consent — when the purpose is reasonably obvious from context (e.g., uploading a site photo so it can appear on your map listing).
- Legitimate business purposes — preventing fraud, securing the Service, complying with legal obligations.
You may withdraw consent at any time by contacting privacy@dirtlink.ca. Withdrawing consent may prevent us from providing parts of the Service.
4. How we share information
We do not sell personal information. We share it only as follows:
- Other users — listing information you choose to publish becomes visible to other DirtLink users in accordance with your subscription tier and privacy settings.
- Service providers — see our Sub-Processor List. Currently: Stripe Payments Canada, Ltd. for payments, Twilio SendGrid for email delivery, DigitalOcean, LLC for hosting. Each is contractually required to protect your information.
- Legal compliance — we may disclose information when required by law, court order, or to protect our rights or the safety of others.
- Business transfers — if we are acquired or merged, your information may transfer to the successor entity, subject to this Privacy Policy.
5. Cookies and tracking
- Essential cookies — keeping you logged in, remembering your preferences. You cannot turn these off and use the Service.
- Analytics — none currently configured. If we add an analytics provider in the future, we will update this Policy and our Cookie Notice and notify you.
- No advertising cookies — we do not run ads and we do not allow third-party advertising trackers.

6. Email communications and CASL
We send commercial emails only where permitted by Canada's Anti-Spam Legislation (CASL):
- Express consent — you opted into our newsletter or marketing communications.
- Implied consent — you have a current business relationship with us, or your business contact information was conspicuously published without a notice prohibiting unsolicited messages and our message is relevant to your business role.
Every commercial email we send includes the sender's identity, our physical mailing address, and a one-click unsubscribe link. To unsubscribe, click the link in any message or email privacy@dirtlink.ca. Unsubscribe requests are processed within 10 business days.
7. Data retention
- Account data — retained while your account is active and for 24 months after closure.
- Listing data — retained while your account is active. You can delete listings at any time.
- Email logs — retained for 3 years as required by CASL.
- Payment records — retained for 7 years as required by Canadian tax law.
8. Security
We use industry-standard safeguards including encryption in transit (TLS 1.2+), encrypted database storage, access controls, and audit logs. No system is perfectly secure. If we detect a breach affecting your personal information, we will notify you and the Office of the Privacy Commissioner of Canada in accordance with PIPEDA breach-notification requirements.
9. Your rights
Subject to applicable law, you have the right to:
- Access the personal information we hold about you.
- Correct inaccuracies in your information.
- Withdraw consent for processing where consent is the basis.
- Request deletion of your account and associated data, subject to retention obligations above.
- Lodge a complaint with the Office of the Privacy Commissioner of Canada or the Office of the Information and Privacy Commissioner of Alberta.

10. International data transfers
Some of our service providers operate outside Canada, including Twilio SendGrid and DigitalOcean, LLC (United States). By using the Service, you consent to your information being processed in those jurisdictions. We use providers that maintain protections equivalent to PIPEDA standards.
11. Children
The Service is not directed to anyone under 18. We do not knowingly collect personal information from children. If we learn we have collected information from a child, we will delete it.
12. Changes to this Policy
We may update this Privacy Policy from time to time. Material changes will be posted on the Service and, where appropriate, communicated by email at least 30 days before they take effect.
